Council to Consider Revisions to Cannabis Cultivation and Commercial Sales Provisions of the City Code

On December 18, 2017, the City Council will consider the 2nd reading of an Ordinance which will update the provisions of the City Code related to cannabis cultivation and commercial sales to conform the City Code to recent changes in state law.

On November 13, 2017, the Piedmont Planning Commission voted unanimously to recommend City Council adoption of an ordinance amending Division 17.48 of the City Code to regulate private cannabis cultivation and commercial cannabis facilities in response to changes in State law. In order to maintain local control over all cannabis land uses to the fullest extent allowed by law, the recommended regulations will:

  1. Prohibit all commercial cannabis facilities for cultivation, distribution, transportation, storage, manufacturing, processing, and sales in all zones;
  2. Allow personal cannabis cultivation inside private residences, subject to reasonable restrictions; and
  3. Allow the delivery of cannabis and cannabis products to individuals within the City limits, subject to reasonable restrictions.

On December 4, 2017, the City Council approved the 1st Reading of the ordinance, as recommended by the Planning Commission. The Council will consider the second reading of the ordinance on December 18th.

Background

The City Code currently prohibits all cannabis businesses. However, it will better serve the public and minimize the potential for confusion regarding the City’s policies by providing updated Code provisions regarding the scope of prohibited conduct and of permissible private cultivation that are consistent with State law, specifically:

  • Proposition 64, entitled the “Control, Regulate and Tax Adult Use of Marijuana Act,” which legalizes and regulates the adult use of non-medical marijuana (recreational marijuana) in California; and
  • Senate Bill 94, known as the Medicinal and Adult-Use Cannabis Regulation and Safety Act.

Public Participation

Members of the public are encouraged to participate throughout this process by submitting comments and attending the meetings. Written comments may be submitted to the Council via email at citycouncil@ci.piedmont.ca.us or via US Mail addressed to City Clerk John Tulloch at 120 Vista Avenue, Piedmont, CA 94611. All meetings are publically noticed. In addition, staff maintains a list of community members who wish to receive email notification of proposed revisions to land use regulations in Chapter 17.
